SMS and MMS Messaging Terms and Conditions

These SMS and MMS Messaging Terms and Conditions ("SMS Terms") govern text messages sent by or on behalf of The Law Office of Hunt, Sockwell, Tinkham and Burress ("HSTB," the "Firm," "we," "us," or "our") through the **HSTB Client Messaging** program.
1. Program Description
HSTB Client Messaging is a low-volume, non-marketing text-messaging program used to communicate with clients and prospective clients about legal-service matters. Messages may include:
- Consultation and appointment scheduling or reminders;
- Court-date, meeting, and deadline reminders;
- Case or matter updates;
- Requests for documents or information;
- Billing and administrative communications; and
- Responses to questions or messages initiated by the recipient.
The program may support both SMS text messages and MMS multimedia messages. HSTB Client Messaging is not used to send marketing or promotional advertisements.
2. Consent and Enrollment
You may enroll by giving the Firm affirmative verbal consent during a telephone call, consultation, intake, or in-person communication. Before enrollment, the Firm will explain the general types of messages you may receive, that message frequency varies, that message and data rates may apply, and how to obtain help or opt out.
By providing affirmative consent, you authorize HSTB to send recurring informational and conversational SMS or MMS messages to the mobile number you provided. Your consent applies only to HSTB Client Messaging and is not permission for unrelated marketing or promotional messages.
Consent to text messaging is voluntary and is not a condition of retaining the Firm, obtaining legal services, or continuing an attorney-client relationship. If you do not consent, the Firm may communicate with you through other appropriate methods, such as telephone or email.
You represent that you are the subscriber or customary user of the mobile number provided and are authorized to consent to messages at that number. Please notify the Firm if the number is reassigned, disconnected, or no longer belongs to you.
3. Message Frequency and Charges
**Message frequency varies** based on your matter activity, scheduled events, and communications with the Firm.
**Message and data rates may apply.** Your mobile carrier's standard messaging, data, and other charges may apply. HSTB does not charge a separate fee for participating in HSTB Client Messaging.
4. Opting Out
**Reply STOP to any HSTB text message to unsubscribe.** You may also use another supported opt-out keyword, such as CANCEL, END, QUIT, or UNSUBSCRIBE. After an opt-out request, you may receive one final confirmation that you have been unsubscribed. No further text messages will be sent through the program unless you later provide new affirmative consent.
Opting out of text messages does not end any attorney-client relationship or prevent the Firm from communicating with you through other appropriate channels.

6. Delivery and Carrier Disclaimer
Text-message delivery is subject to your device, mobile carrier, network availability, and other conditions outside the Firm's control. Delivery may be delayed or fail. **Wireless carriers are not liable for delayed or undelivered messages.** HSTB does not guarantee that any message will be received within a particular time.
7. Confidentiality and Appropriate Use
SMS and MMS communications may not provide the same security as a secure client portal or other protected communication channel. Messages may appear on a locked screen or be accessible to anyone with access to your device or mobile account. You are responsible for maintaining reasonable security over your device and promptly telling the Firm if your number or device is lost, compromised, reassigned, or no longer under your control.
Do not use text messaging to communicate an emergency, a last-minute court issue, or other information requiring guaranteed or immediate delivery. Text messages do not amend an engagement agreement, create an attorney-client relationship, constitute a court filing, or replace compliance with any court order, deadline, or instruction from counsel.
8. Privacy
Our collection and use of information through HSTB Client Messaging are governed by the [HSTB Privacy Policy](https://www.hstblaw.com/privacy-policy).
We do not share, sell, rent, or provide mobile phone numbers or SMS/MMS opt-in data and consent to third parties or affiliates for their marketing or promotional purposes.
9. Program Changes or Termination
The Firm may modify, suspend, or discontinue HSTB Client Messaging or update these SMS Terms from time to time. Updated SMS Terms will be posted on this page with a revised effective date. If the program is discontinued, the Firm may continue communicating through other appropriate channels.
